Tenant v. 12 Oaks at Woodfield
Illinois Renters' Rights Enforced
by Class Action
This case
appeared as a top New Suit of the day in the law bulletin.
The putative
class consists of all similarly situated renters at a huge 692-unit Rolling Meadows apartment
complex.
Allegedly,
interest was not paid within 30 days from the end of each rental period, or
ever. An owner of the property, Michael Sparks, was
reportedly quoted by local media stating:

"Interest on
security deposits was less than $1 per renter, but it was six
months before we caught the mistake and started paying it" |
Security
deposits were also allegedly withheld after move-out without any written explanation.
Tenants brought their claims under the
Illinois
Security Deposit Interest
Act and under the
Illinois Security
Deposit Return Act, and also breach of contract.
Twelve-Oaks at
Woodfield sits
just north of Woodfield Mall,
and is the subject of much local interest
because of its location and size.
