Oak Park renters at buildings with four (4) or more units have security deposit rights beyond those of renters statewide.
Oak Park renters of ANY residential unit (condo, house, or apartment) may be able to break their lease.
 
     OAK PARK ILLINOIS sits just west of Chicago, and gives its tenants some extra rights beyond the Illinois Security Deposit Interest Act and Security Deposit Return Act.

     The Illinois Security Deposit Return Act only requires landlords of buildings with five (5) or more units to provide a written itemized accounting, and then paid receipts, in order to withhold from a tenant's security deposit for alleged damage.  Oak Park has lowered that number to four (4) units, thus bringing more tenants at smaller buildings within the scope of Oak Park's rules for security deposit return - and the potential for double damages.

     The Illinois Security Deposit Interest Act only requires landlords of buildings or complexes with 25 or more units to pay annual interest.  Oak Park has lowered that number to four (4) units also.  However, there is no corresponding penalty for landlords who willfully fail or refuse to pay the interest when due, as provided for in the Illinois Interest Act.

     Finally, ALL residential renters in Oak Park are covered by a rule that allows early lease termination by a tenant if the landlord fails to comply with the law.
