This case
appeared as a top New Suit of the day in the law bulletin.
The putative
class consists of more than 400 renters at a large 4-building Chicago apartment complex
near O'Hare.

In this case,
it was claimed that the landlord illegally mortgaged tenants' security deposits.
A ruling on defendants' motion to dismiss that claim
yielded a favorable written ruling on "encumbered deposits" under
RLTO § 080(a).
Damages equal
to two-times each tenants' security deposit are sought for this allegedly
unlawful subjection of tenant security deposits to the claims of landlords'
creditors.
Also, damages
equal to one-month's rent for each tenant are sought under
CRLTO § 100 for the
landlords' alleged failure to disclose recent building code violations
cited against the 4-building complex when entering into leases.
