Tenant v. Astor House LLC

Chicago Renters' Rights Enforced by Class Action

This case was filed on behalf of all tenants at the 120-unit apartment high-rise at 1246 W. Pratt in the Rogers Park neighborhood.  The named plaintiff had lived at the building more than 12 months, and alleged he wasn't paid interest on his "last month's rent" held for more than 18 months.  Damages equal to double the prepaid rent are sought for this under RLTO § 080.

Also, it was alleged that building code violations were cited against the building in the 12 months before plaintiff and other renters signed leases or renewals of leases in 2005 through 2006, so damages equal to one-month's rent per tenant are sought under RLTO § 100.

It is also alleged that renters were not given proper summaries of the Chicago Residential Landlord Tenant Ordinance with their leases and renewals of leases, so $100 in damages plus costs and attorney fees is sought for each renter under RLTO § 170.

Copies of leases that renters have from 2005 through 2006 are especially requested, in order to get renters at this building what they deserve.
